TRADEMARKS, COPYRIGHT, INTELLECTUAL PROPERTY

The JOHANAWILLA trademark remains the exclusive property of JOHANAWILLA LTD. The trademark is protected by International and UK Copyright and other Intellectual Property laws. The symbol '®' and "™" where there is written "JohanaWilla®","W®" or "Exquisite Prosperity™" indicate the international ownership of the name and slogan by the company. At the bottom of the page the symbol "©" is referred to the authorship of this website by the company JOHANAWILLA LTD.

 

Article 1. LEGAL TERMS:

"The company" / "Us" / "Our" refers to the company JOHANAWILLA LTD. "The customer" / "You" refers to you, the customer.

Terms of Use are a legal agreement between the customer and the company. It applies to the use of the website including the sale of retail goods. The customer must read, agree with and accept all the terms contained in this agreement. 

ORDERS

​Orders may only be placed from individual customers and corporations purchasing goods other than for resale. All orders placed by the customer are subject to the acceptance of the company. The company reserve the right at all times and at its sole discretion to refuse to accept an order for any reason and without liability to the customer.

After the customer has placed the order, the company will send to the customer an order confirmation by email with the order number and details of the product that have been purchased. Once your order is confirmed, we are unable to alter the delivery address or method, or any details within your order, such as product, number of products, size, colour.

ORDERS PLACEMENT

The customer may browse the website without registering but when placing the first order it can choose to do so as a guest or by registering with the company. If the customer decide to register it will need to complete certain fields on an order form. The username will be the email address the customer has used to register. In doing so the customer gives the company a commitment that the customer is authorised to use the address in question. The customer will also be asked to input a password. The customer should not disclose or transfer its password to any other person. The customer must notify the company immediately if it becomes aware of any unauthorised use of its password. Without prejudice to the company's rights, the company may suspend the access to the website to the customer without liability to itself if in the company reasonable opinion such action is necessary to safeguard the website. Before the customer submit its order it will be given the opportunity to review its selection, check the total price of the order and correct any errors. The customer's order represents an offer by itself to purchase products.

DESCRIPTIONS AND PRODUCT INFORMATIONS

The company have made every effort to represent the colours of the products as accurately as possible. However due to differences in monitors the company is unable to guarantee that the colour you will see on your monitor will reflect the true colour of the product. If the customer has any questions about the product it may of course contact the company by email in the Contact section. The company reserve the right to change at any time and without any previous notice the items offered on our website.​

The measurements given are in inches and cm.

PRICE

Depending of the customer location and country currency, the customer has the option to select the currency of its country. It can be done by selecting the currency on the top left of the page (or on the menu section if browsing on a smartphone). You may browse the website picking a specific currency however the checkout price will be done in GBP.

 

The prices include VAT @ 20% (payable if delivery is within the UK) but exclude delivery charges, which are detailed separately. 

The company may change the prices on the website at any time and without any notice. The company try to ensure that all prices given on the site are correct. However, mistakes can occur. If the company have quoted an incorrect price on the site and if the correct price is lower than that quoted, we will automatically assume that the customer wish to continue with the order. However if the correct price is higher than that originally quoted, the company will contact the customer to ask if it still wants to order the goods.

PAYMENTS

The customer confirms that it is authorised to use the credit card/debit card whose details entered. All credit /debit cards are subject to validation checks and authorisation by the card issuer. If the issuer of the card refuses to authorise the payment the company will not accept the order. Furthermore the company will not be liable for any delay or non-delivery. The company is not obliged to inform the customer of the reason for the refusal. The company has no responsibility for the customer's bank or card issuer charges as a result of the process of the customer's credit /debit card payment in accordance with its order.

What payment options are accepted? Visa, MasterCard, Amex, ChinaUnionPay, JCB, CB, Discover, Visa Electron, Maestro, Google Pay, Apple Pay. 

DELIVERY

UPS is our carrier for all shipments. You may choose a delivery address which is different to your billing address.

Orders will be sent to the delivery address that the customer has submitted on the order form. The company cannot be held responsible if that delivery address is incorrect. Please note that the company cannot deliver to PO boxes. 

DELIVERY SIGNATURE: All orders require signature upon delivery, at which point responsibility for the shipment passes to the customer. If the customer has specified a recipient other than itself, that signature by the third party is sufficient proof of delivery and fulfilment by the company. 

All deliveries are made from Monday to Friday. Shipping timing begins when the customer receive the shipping confirmation email. All orders are fully traceable. If checked in as a registered user, log into your account to check the most up-to-date status of your order. Delivery times are provided as guidelines only and do not take into account possible delays caused by payment authorisation and/or stock availability and/or customs delays.

If the goods cannot be delivered, due to a delay in the supply of goods, within 30 days of the order, the company will notify the customer and the customer may either cancel its order or agree a further delivery time with the company.​

CUSTOM AND DUTIES

The receiver may be required to pay Import Duties that are levied once the package reaches the destination country by the destination country's customs authorities. These charges are to be borne by the receiver. The company has no control over these charges. 

 

In case the receiver fails to pay the asked Duties & Taxes and doesn’t collect the order from the shipping partners the company will not be liable for any refund amount for such orders. The customer is considered by the company to be aware of and comply with all laws and regulations of the country in which the customer is ordering the products.

RETURNS

If, for any reason the customer is unhappy with its purchase, it can return it unworn and unused within 14 days of the date of the delivery. All items which the customer wish to return must be returned in their original packaging intact. 

 

First, please email the company in the Contact section with the customer's name, order number and the reason for the return. Should the customer wish to return the order for personal reasons including a change of heart, it will be responsible for any postal charges relating to the return. It's the customer responsibility to send the package. In order for the customer service to accept the return, the product(s) must be returned in full condition in its original packing, undamaged, not worn, accompanied by all of its accessories, and a copy of the purchase invoice.

Please note that the items must be in re-saleable condition and that personalised items are non-exchangeable, non-refundable. In any event damaged or worn items will not be refunded or exchanged.

The refund can only be made to the card used when paying for the order. The company will email the customer once it has received the goods back from the customer. Additionally, the company will place a credit to the credit/debit card used to purchase the goods normally within 14 days of receipt of the goods by the company.

 

JohanaWilla does not have an exchange service. After returning a product, if the customer wants another item, a different colour, please place a new order. 

Under the Consumer Protection (Distance Selling) Regulations 2000 and 2005 the customer has a right to cancel orders for items purchased from the website within a statutory cooling -off period. An order can be cancelled from the day the customer ordered the purchase until the company shipped it. Once the package is in transit with the carrier it won't be eligible to a cancelation. If the customer want to change it after receiving it, the customer will have to engage a return process. The customer will have 14 days to get the goods back to the company from the day it get delivered. Shipping/delivery charges are the customer's responsibility. To cancel an order, please provide the company with notice by email, within the statutory cooling off period and giving details of the items ordered and (where appropriate) their delivery date.

If the customer exercise its rights to cancellation after the item has been delivered, please follow the instructions for returns above to the stated address. Please note the customer will be responsible for the costs of returning the items to the company unless the company delivered it in error.

FINANCING

The customer has the option to pay with a payment in several instalment with Klarna. 

The Gift Card can only be purchase on this website by using the prepaid payment modes above - Credit Card, Debit Card. Each Gift Card will have a validity period of 1 year from the date of its purchase. It is neither transferable nor refundable. It can only be used online on this website and not at any Retail Store.

In case of return of the purchased item, please refer to our Return Policy. If the order is cancelled, the Gift Card amount shall be refunded to the source Gift Card however validity of the same will be governed by the initial purchase date of Gift Card. ​If the order value exceeds the Gift Card amount, then the balance amount can be paid via Credit Card,  Debit Card or Internet Banking. ​The Gift Card can be redeemed by selecting the payment mode as Gift Card on the checkout pages. 

Once the Gift Card has been sent to the customer by email, the customers are bound to protect the Gift Card number. In the event of any misuse of Gift Card due to loss of any such confidential details due to the mistake of the purchaser/customer, the company shall not be held responsible/liable in any manner and no refund shall be given/issued against such Gift Card by the company. The Company reserves the right to extend or not to extend the validity of any Gift Card at its sole discretion. The Company reserves the right to cancel a Gift Card if fraudulent use has been suspected or declared.
